Environmental due diligence has changed over the past several years, especially in 2021. This has lead to new mitigation requirements for many properties that were considered “clean” prior to 2013, and extended negotiations with the Department of Environment, Great Lakes and Energy (EGLE) for most urban sites. As if that was not enough, the capital stack for your project may have hidden requirements for even more environmental due diligence and EGLE approvals. All of this has resulted in uncertainty, especially for mixed use projects, increased assessment times, and increased costs for remedy. The good news is that early planning makes a big different, and there may be incentives available to reduce some of the pain.
